Terms of Service

The service

tapitfindit lets you create digital tags, write their links to NFC stickers or display them as QR codes, and show a public “found it” page with the details you choose. When someone scans a tag, we log the scan, notify you, and relay any message they send. The service is provided on an ongoing basis and we may add, change or remove features over time.

Your account

• You must provide a valid email and keep your credentials secure.
• You are responsible for activity under your account. We recommend enabling two-factor authentication.
• You must verify your email before you can use the service, and you must be at least 16 years old.
• You must provide accurate information, and keep it up to date.

Acceptable use

You agree not to:

• Store unlawful content, or anyone else’s personal information without a proper basis.
• Use the contact form, found-item reports or notifications to send spam, harassment, or malicious content.
• Attempt to break, overload, reverse-engineer, scrape, or gain unauthorised access to the service or other users’ data.
• Use the service to track, surveil or locate people without their knowledge and consent.
• Resell or commercialise the service without our written permission.

We may suspend or remove tags, content or accounts that breach these terms or the law.

What you share is your choice

You control which tag fields are public. You are responsible for the information you choose to display, and you must have the right to share it. Do not make public anything you are not comfortable showing to whoever finds your item. Tag contents you record stay private and are shown only to you.

Finders and found items

If you find a tagged item, you can use the public scan page, or the app, to let the owner know. If you report a found item while signed in to the app, your account name and email are shared with the owner so they can arrange its return. Contact owners only to help return their item, and treat any information you see responsibly and lawfully.

No guarantee of return

tapitfindit helps a finder reach you, but we cannot guarantee that a lost item will be found or returned, that a scan will occur, that a notification will be delivered, or that a finder will act honestly. You remain responsible for your own property.

Plans, billing and renewals

• Setting up tags is free. Making a tag’s public link live, and some features, require a paid subscription. Current plans and prices (in Australian dollars, inclusive of GST where applicable) are shown on our pricing page.
• Paid subscriptions are billed in advance and renew automatically each term until cancelled. You authorise us and our payment provider (Stripe) to charge your payment method for each renewal at the then-current price.
• You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current paid period; you keep access until then. We will give reasonable notice of any price change before it applies to your renewal.

Physical NFC tags

Physical NFC tags are sold separately. We aim to ship promptly to the address you provide; delivery times are estimates. Risk in the goods passes to you on delivery. If tags arrive faulty, damaged or not as described, we will replace them or refund them as required by law (see below).

Refunds and consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss; for failures that are not major, you are entitled to have problems fixed in a reasonable time.

Outside those rights: subscription fees and renewals are generally non-refundable for change of mind, since you can cancel future renewals at any time. For physical tags, if you change your mind you may return unused tags in their original condition within 30 days for a refund of the product price, with return postage at your cost. Faulty or incorrect items are remedied at our cost.

Intellectual property

The tapitfindit name, logo, and software are owned by Spherify Pty Ltd. The content you enter remains yours; you grant us the limited, worldwide licence needed to operate the service (for example, to store your data and display the fields you mark public on your scan page). We do not claim ownership of your content.

Disclaimers and liability

The service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude implied warranties and are not liable for indirect, incidental or consequential loss, loss of data, or for lost, stolen, damaged or unreturned items or the conduct of finders or other users. Where our liability cannot be excluded but can be limited, it is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these terms.

Termination

You may delete your account at any time from your settings. We may suspend or end access for breach of these terms, to protect the service or other users, or to comply with the law. Some provisions (including intellectual property, disclaimers, liability and governing law) survive termination.

Governing law

These terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia and the courts able to hear appeals from them.

Changes and contact

We may update these terms from time to time; material changes will be posted here with a new “last updated” date and, where appropriate, notified by email.
